Chemical Regulatory Compliance & Safety

1. STATUTORY FRAMEWORK & PURPOSE

BIDCHEMZ.COM ("Platform"), operated by Blue Litmus Bizconnect ("BLB", "BidChemz", "we", "us"), is committed to the highest standards of safety, legal integrity, and statutory compliance in the B2B chemical sector. Due to the high-consequence nature of chemical trading, all members must understand that transactions on BidChemz are strictly governed by applicable Indian Union and State regulations, environmental safeguards, and international chemical conventions.

This Chemical Regulatory Compliance & Safety Policy ("Compliance Policy") establishes mandatory requirements for all manufacturers, importers, stockists, traders, and institutional consumers participating on the Platform.

2. STATUTORY LICENSING & REGULATORY OBLIGATIONS

Trading in chemical substances requires specific statutory permissions depending on toxicity, flammability, and industrial classification. Both buyers and sellers represent and warrant that they hold active, valid licenses for all products they buy, sell, or store:

  • State Pollution Control Board (SPCB / PCC) Consent: All manufacturing and chemical processing facilities must maintain valid Consent to Establish (CTE) and Consent to Operate (CTO) under the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981.
  • Petroleum & Explosives Safety Organization (PESO): Members dealing in compressed gases, petroleum products (Class A, B, C), ammonium nitrate, calcium carbide, or hazardous flammable solvents must hold active PESO storage and handling licenses under the Petroleum Rules, 2002 and Explosives Rules, 2008.
  • Poison Act & Toxic Substances Licensing: Regulated poisonous substances (e.g., arsenic compounds, cyanides, mercury salts, concentrated mineral acids like hydrofluoric acid) may only be sold to, or purchased by, entities holding valid Poisons Possession and Sale Licenses issued by the competent State Home Department or District Magistrate.
  • MSIHC Rules, 1989: Entities storing or handling chemicals listed in Schedules 1, 2, and 3 of the Manufacture, Storage and Import of Hazardous Chemical (MSIHC) Rules, 1989 must maintain up-to-date Material Safety Data Sheets, site emergency plans, and safety audit disclosures.

3. CONTROLLED PRECURSORS & DUAL-USE CHEMICALS

BidChemz strictly enforces compliance with national and international security conventions:

  • NDPS Precursor Chemicals: Substances categorized as controlled precursor chemicals under the Narcotic Drugs and Psychotropic Substances (NDPS) Act, 1985 and the NDPS (Regulation of Controlled Substances) Order, 2013 (including Acetic Anhydride, Ephedrine, Pseudoephedrine, Anthranilic Acid, Potassium Permanganate, and Norephedrine) require mandatory registration with theNarcotics Control Bureau (NCB). Sellers must record and verify the buyer's NCB registration and Form 1 / Form 2 documentation prior to confirming any transaction.
  • Chemical Weapons Convention (CWC): Chemicals listed under Schedules 1, 2, and 3 of the CWC and theChemical Weapons Convention Act, 2000 are subject to strict monitoring. Schedule 1 chemicals are strictly prohibited from listing. Schedule 2 and 3 chemicals may only be traded with verified annual declarations and designated industrial end-use certificates.
  • Ozone Depleting Substances (ODS): Regulated chlorofluorocarbons, halons, and hydrochlorofluorocarbons are subject to theOzone Depleting Substances (Regulation and Control) Rules, 2000 and phase-out quotas.

4. PROHIBITED SUBSTANCES & LISTING RESTRICTIONS

The following products are strictly prohibited from being advertised, listed, or transacted on BidChemz under any circumstances:

  • Illicit narcotics, psychotropic drugs, or scheduled pharmaceutical formulations intended for personal consumption.
  • Unlicensed finished explosives, fireworks, detonators, or improvised weapon components.
  • Radioactive, nuclear, or fissile materials governed by the Atomic Energy Act, 1962.
  • Chemicals banned under the Stockholm Convention on Persistent Organic Pollutants (POPs) or Rotterdam Convention on Prior Informed Consent (PIC).
  • Counterfeit, adulterated, diluted, or falsely branded chemical formulations.

5. SAFETY DATA SHEETS (SDS / MSDS) & GHS CLASSIFICATION

Transparency and hazard awareness are essential to protect human health and the environment:

  • Mandatory SDS Disclosure: Sellers listing any chemical product must provide an up-to-date Safety Data Sheet (SDS) adhering to the 16-section standard prescribed by the Globally Harmonized System of Classification and Labelling of Chemicals (GHS).
  • CAS & Grade Transparency: Every product listing must disclose its accurate Chemical Abstracts Service (CAS)registry number, chemical formula, commercial IUPAC name, and technical grade (e.g., Industrial, Pure, Reagent, Food Grade, Pharma Grade USP/BP).
  • Hazard Pictograms: Listings must clearly indicate applicable hazard pictograms (flammable, corrosive, toxic, health hazard, environmental hazard) and appropriate UN numbers for transport.

6. PLATFORM AUDITS, KYC & REPORTING COOPERATION

To safeguard the marketplace ecosystem:

  • KYC Document Verification: BidChemz performs independent verification of GSTIN, PAN, and corporate credentials. BidChemz reserves the right to demand certified copies of statutory chemical handling licenses at any time.
  • Suspension of Defaulters: Any user found offering unverified, banned, or illicit substances, or attempting to trade without required licenses, will have their account immediately terminated, active listings delisted, and forfeits all platform fees.
  • Law Enforcement Cooperation: BidChemz cooperates fully with the Ministry of Chemicals and Fertilizers, Central Pollution Control Board (CPCB), Petroleum and Explosives Safety Organization (PESO), Narcotics Control Bureau (NCB), and law enforcement authorities investigating illegal chemical trafficking or regulatory breaches.
